About this deal

A jailhouse lawyer’s right to have another prisoner’s legal papers in their possession is inconsistent. In one case, the court held jailhouse lawyers must be able to possess papers pertaining to their “client’s” case. See: In re Harrell, 470 P.2d 640 (Cal. 1970). Another court interpreted a regulation as authorizing documents to be kept by the jailhouse lawyer only until the petition was complete, after which the papers had to be returned to the “client.” See: Gilmore v. Lynch, 319 F. Supp. 105 (N.D. Cal. 1970).

While in prison, he also became associated with the Carlton gang’s arch-enemy Carl Williams. A turf war between the two factions has been linked to the deaths of 36 men between the 90s and the 2000s. As she arrives in Bassville, she finds that there has been a double murder in the local area. The only survivor, Amber Travis has been kindly treated by the community but there's something wrong, terribly wrong. Not meaning really to set up a law practice locally, Leah pledges to wind up her father's law practice, that's what she means to do. But Amber needs a lawyer, she believes she is the rightful heir of her cousin's estate and has nothing else. She asks Leah to represent her. Related to the issue of who may receive legal assistance from a jailhouse lawyer, is the problem of who among the inmate population may act as a jailhouse lawyer. Courts have stressed the right asserted in Johnson v. Avery was not the privilege of the jailhouse lawyer to practice law. Rather, it was the right of an inmate to receive legal assistance from a fellow prisoner. See: Bounds v. Smith, 430 U.S. 817 (1977).

These words were written on a letter I held in my hands two years ago. It came from a man in solitary confinement. He wrote that corrections officers found a Motorola phone in his cell. As a result, he was given six months in the box. More than just contraband, authorities believed the phone — with possible access to apps like Uber and Google Maps — was an escape tool. This made the consequences more severe, and included the possibility of a lengthened prison sentence. Legal empowerment is the belief that impacted communities must lead their own struggle for justice. This panel explored how the cycle of legal empowerment – a process of knowing, using, and shaping laws - can destroy the cycle of incarceration. Too often, the abolitionist movement relies on voices outside of the prison walls. The program reflected on the ways incarcerated folks have obtained freedom from the inside out through the legal empowerment of the incarcerated, their families, and communities. As I sat in the bullpen, I cried. “They want me to die in prison ,” I thought . But the panic of the moment thrust me into survival mode. And if I was going to survive, it was the law that would help me. Leah Randall is a very new (three years in) attorney who has been practising as an associate in a Chicago law firm until this story. Following messages from her mother (whom she speaks to once a year) about her father's health, she quits her brand-new career to go to her hometown of Bassville, Arkansas.

Few will have the greatness to bend history; but each of us can work to change a small portion of events, and in the total of all those acts will be written the history of this generation ... It is from numberless diverse acts of courage and belief that human history is thus shaped. Each time a man stands up for an ideal, or acts to improve the lot of others, or strikes out against injustice, he sends forth a tiny ripple of hope, and crossing each other from a million different centers of energy and daring, those ripples build a current which can sweep down the mightiest walls of oppression and resistance."McCulloch said: “Murder is always wrong. I was friends with the factions in the dispute because I had no criminal involvement within any of them. To get a job in the law library you must pass a law clerk test that’s offered once a year. Generally, you can only take the test after completing a 14-week legal research class taught by prisoners. This doesn't detract from their intensity, their intrigue, or their readability; however, it would seem advantageous to let readers know there are actually two distinct, separate stories in the book.
