Family law in these countries generally follows the prescriptions of Koran. Veiling (hijab), divorce laws, a very young legal age of marriage, custody of children, polygamy, women’s rightlessness in matters of employment, travelling, choosing the place of residence, honor killing are all aspects of Islamic Shari’a based on the Koran and Islam’s doctrine. Together with these, in countries under the Islamic states, women are stoned to death for engaging in voluntary sexual relations and are stripped of their basic human rights. In all of these countries all of these atrocities are illegal, they are banned, and you have several different punishments for them. For instance, for causing bodily harm (because female genital mutilation falls under bodily harm) in the Netherlands, to a child, an individual, you could get a maximum sentence of 15 years. I’m sure you get more than that in the US. But the problem is that it is not enforced, so government is negligent in failing to devise a control system to counter that, to protect children. And the same applies to forced marriages, and honour beatings. For an honour killing the government will say that’s murder and the law will go after the murderer, and the murderer will be put in jail. But the government is again negligent in pursuing all the individuals that are involved in that murder.

O prophet! We allow thee they wives whom thou hast dowered, and the slaves whom thy right hand possesseth out of the booty which God hath granted thee, and the daughters of thy uncles, thy paternal and maternal aunts who fled with thee to Medina, and any believing woman who hath given herself up to the Prophet, if the prophet desired to wed her – a privilege for thee above the rest of the Faithful. We well know what we have settled for them, in regard to their wives and to the slaves¦; that there may be no fault on thy part ¦ giving the absolute power to the man to repudiate his wife and marry another without any formalities. In fact more than two dozens verses in Allah’s scripture explain the modes of divorce (Koran 2: 226, 227, 228, 230 -37, 241, 242; 4: 19-21, 130; 33: 49; 58: 3, 4; 63: 1-7; 4: 35). While most Muslim scholars reject what they call the external imposition of the universal models of gender equality on Muslim societies, this dichotomous framing of external vs. internal is rather inaccurate and even misleading. These universal models of women’s rights are based on basic principles of freedom and equality and many women and organizations in Muslim countries are heavily involved in these international efforts. The most recent international legislation regarding gender equality is the United Nations Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) adopted in 1979 and ratified by 189 states, which is comparable to a bill of human rights for women. 16 All Arab countries have signed and ratified the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) 17 but with so many reservations 18 that defeat the purpose of the convention. Meanwhile, Arab and Muslim countries continue to impose some the worst discriminatory daily practices against women in the world, with religious, social, and legal justifications. While religious reform and alternative interpretations are an essential part of the change process, international efforts and the progress they have achieved need not be overlooked. The Koran is supposed to be the words of God and the Hadith are the sayings and deeds of the prophet. The Koran has the basic commands; the Hadith or the Sunna, is a sort of manual. It is supposed to be a guideline of how to understand the Koran, because people say that it’s not explicit enough. The Hadith is a compilation of six volumes and they are called the Sahith Sitta – Sitta just means six and Sahith means authentic.

In fact, in another instance, the second successor to the Prophet, Umar ibin Khattab, appointed a woman to manage the affairs of a market in Medina. 8 The hadîth however refers to four women who acquired perfection in faith and character by virtue of their devotion, patience, toil and morality. Their lives radiated with piety, trust, patience and gratitude. Their lives serve as beacons of guidance for all believers, especially in times of hardship, difficulty and struggle.
