Applying these modern investigative methods to cold cases is an important step toward success in clearing them. But law enforcement agencies across the country can also improve their results in solving some of the hardest cases that come across an investigator’s desk by allocating resources efficiently through agency partnerships and prioritizing cases based on solvability. Cold Cases, Contemporary Methods
Often, cold cases run cold simply because the people involved don’t have the detective tools they need to find people. A cold case investigation is when someone uses new tools and techniques to investigate a case that has gone cold. Who can do a cold case investigation?Multidisciplinary response: Effective practices, including creating and maintaining a sustainable sexual assault response team (SART) or multidisciplinary team (MDT). Because we knew there was some foreign blood present at the scene, we were very keen to try and find some more. There was very little left of the original foreign blood because it had virtually all been used up in testing as every new DNA technique that was developed was applied to it to the extent that the case essentially described a large part of DNA profiling history. But, for one reason or another, none of this testing was successful and, in the end, we were having to be as imaginative as possible about where to look for more of this foreign blood. Detectives arrested alleged serial rapist in McAllen on two cold case sexual assault warrants based on DNA evidence. When this information came to light in 2011, Cook County Sheriff Tom Dart and I discussed at length reopening the case. We concluded that, due to the heinous nature of the crimes, these victims were deeply deserving of another chance at identification. Indicted 7 homicide-related sexual assault cases; there have been a total of 107 various indictments since 2015.
Related to this is the problem of sensitivity of familial relations that may be exposed. In various countries, familial searching in forensic databases is increasingly conducted, but it is often strictly regulated. With a forensic STR profile, one can search the forensic database to potentially—in an ideal case, because this is often quite hard—identify a parent, child or sibling of the uploaded STR profile. 32 By contrast, SNP profiles used by DTC companies are generally capable of identifying third cousins (having great-great-grandparents in common) or even more distant relatives. Of note, one individual has on average almost 5000 fifth cousins. 13 The chance of finding at least one third cousin in a database of one million people is reportedly already as high as 90%. 33 The possibility of using commercial SNP profiles to identify both close and distant relatives may bring unwelcome (or welcome) information to light for a family: there could be revelations of misattributed parentage or siblings who turn out to not be siblings at all. An in-depth forensic search in a commercial genealogical database may expose this information. Obviously, exposing this information is also a risk when taking a commercial DNA test. However, the extensive family tree search that is performed by a genetic genealogical expert in IGG is not standardly conducted for regular customers. Notably, this family search is usually conducted unbeknownst to the innocent family members; therefore, this information may come to light to the police, but presumably not to the family members themselves. Still, it could be disclosed; and this risk is greater in comparison to traditional forensic databases because in the latter the amount of sensitive information that can be retrieved is very limited.First and foremost, there are some tools and supplies you’ll need if you want to conduct a cold case investigation. Often, cold cases run cold simply because the people involved don’t have the detective tools they need to find people. Other benefits of cold case efforts are more amenable to measurement. For example, the report noted large and increasingly effective DNA databases may reduce the need for and cost of law enforcement investigative resources by making solving cold cases more efficient or less time-consuming. Reasons to Reopen Cases The Working Group called upon law enforcement to take advantage of new forensic technologies and crime databases. Utilize academic resources when possible and appropriate. These resources may include technologies, students, and faculty with subject matter expertise.
The Working Group’s 23 recommendations for best practices are designed primarily to assist law enforcement administrators and command staff. The recommendations fall into five categories: Implement a cold case unit as a separate, defined unit within an agency. Position the unit in an existing bureau, division, or branch responsible for investigative activities.The potential impact of such forensic use of DTC databases for crime investigations is enormous. For example, it has been estimated that a genetic database consisting of only 2% of all US citizens of European descent will be able to find a third-degree cousin in more than 99% of all US persons of that ethnicity. 11 As the DNA of millions of people is in these databases, the chance of finding a distant relative will possibly become almost certain. If an increasing amount of these DNA data would be accessible for law enforcement, it can have major implications for criminal investigations. Although currently, most consumers of DTC companies are US citizens, the kits are also increasingly popular in other countries around the world. Therefore, it is likely that IGG will become more and more effective in identifying suspects outside of the USA. For example, a UK study was able to identify 4 out of 10 anonymous volunteers by uploading their genealogical DNA profile to GEDmatch. 12 The genetic relatedness between individuals complicates the issue of individual consent in the IGG context. In the ethical debate about genetic testing in a healthcare setting, consequences for relatives of the consenting person are a central issue. Therefore, for our debate on IGG, it may be helpful to briefly look at genetic testing in a healthcare context to examine how individual informed consent and its consequences for relatives are approached in this context. The report concludes, The time has come for forward-thinking, innovative law enforcement leaders to embrace the investigation of cold cases as an integral part of their agencies’ core mission. At the very least, bringing a cold case up to today’s technological and investigative standards gives the case a better chance of being resolved. Simply moving a case to a ‘contemporary status’ gives us the best chance at providing families an answer because they carry the burden of having a loved one murdered or missing and not knowing what happened to them. Finding Support for Cold Case Units The Texas Ranger Division will work with the Texas Department of Criminal Justice, TXDPS Crime Records, and the TXDPS Crime Lab to determine the total number of felons and sex offenders who lawfully owe DNA, but have yet to provide their DNA sample. Texas Rangers have identified 3,300 registered sex offenders in Texas who owe the state a DNA sample for entry into CODIS. The cold case work I have done has mainly been for the police, who tend to get in touch with me when they’re reviewing a case after a lapse of few years and who think there might be some new technology in the forensic line that might help. I have also, on occasion, been approached by the families of victims or the lawyers representing them and so we’ve started reinvestigating something because of that. Those are the two main routes.”
Fortunately, Kadner had something to work with.
