About this deal

This policy details NHS Fife’s commitment to the Working Time Regulations 1998 (as amended) and sets out the obligations of managers, staff and staff side representatives. Working time is any time during which a worker is working, at the employer’s disposal and carrying out the employer’s activity or duties and any period during which the worker is receiving relevant training and any additional period which is to be treated as working time under a relevant agreement. The determination for Regulation 22 Police Regulations 2003 now provides that time spent in travel, outside of rostered duty hours and not already covered by the travelling time treated as duty provisions, to and from duty at a place other than the normal place of duty; and time spent in travel to and from training courses other than at the usual lace of duty are to be treated as working time.

However, there are a number of special circumstances in which the entitlement to rest periods does not apply, for example, where the activities involve a need for continuity of service or production or where there is a foreseeable surge of activity. Also, if a shift worker changes shift, it may not be possible for them to take their full rest entitlement before starting the new pattern of work. In such a case the entitlement to daily and weekly rest does not apply. Weekly rest There are some exceptions, for example for people who work in hospitals, agriculture, retail work, hotels, catering, bakeries, post/newspaper deliveries or people who work in connection with cultural, artistic, sporting or advertising activities. If your employer won't let you take a rest break Line Managers require to keep records of the hours actually worked by employees on-call. These records may be shared with staff side colleagues, upon request.
