In treachery, it makes no difference whether or not the victim was the same person whom the accused intended to kill (when there is treachery, it is impossible for the victim, either the intended one or not, to defend himself) A person may not be indicted for treason committed within the United Kingdom (subject to the following exception) unless the indictment is preferred within three years of the commission of that offence. Until 1945 treason had its own rules of evidence and procedure which made it difficult to prosecute accused traitors, such as the need for two witnesses to the same offence. For example, the jury cannot give an alternative verdict of manslaughter in cases of the assassination of the monarch. The Homicide Act 1957 does not apply. However, under the common law the jury may return a verdict of guilty of misprision of treason instead of treason.
