The Kenya National Union of Teachers ( KNUT) was founded on 4 th December 1958 and entered into a recognition agreement with the Teachers Service Commission ( TSC) on 15 th May 1968. It represents unionisable public school teachers employed by the government in primary schools. The K enya Union of Post Primary Education Teachers ( KUPPET) was founded in 1998 and entered into a recognition agreement with TSC on 2 nd June 2010. As its name shows, it represents unionisable teachers employed by the government in Post Primary Public institutions. There were 288,000 registered teachers as at the time the dispute arose. The relevant events for purposes of this judgment started in 1996 which are summarized below. b) advise the national and county governments on the remuneration and benefits of all other public officers.” Application for different categories of leave shall be considered and approved strictly in accordance with Part X of the CORT. However, the Commission shall grant: The Teacher Service Commission to demonstrate budgetary provision for the proposed remuneration structure before seeking advice from SRC.
The offer was ultra vires article 230(4) (b) of the Constitution and ultra vires section 37(3) of the TSC Act. No enforceable right arises and accrues from an ultra vires action. The TSC offer was a constitutional and statutory nullity and nullity begets nullity. The trial court thus erred in not evaluating the offer by TSC to determine if it was intra vires the Constitution or intra vires the TSC Act. The trial court erred in finding there was a valid offer made by TSC to pay a 50 – 60% basic increment.
The commission does not concur with TSC’s proposal to increase the basic salary by 50% - 60% as the rationale for the proposed increment has not been provided. Further, TSC has not demonstrated affordability of the proposed increment. Any proposal for salary increment in the public sector must take into account the financial impact of the increment and the effect on other sectors of the public service. When TSC made the offer of 50 – 60% at the consultative meeting, it had neither sought nor obtained mandatory constitutional SRC’s advice as required by the Constitution and statute. TSC sought the advice from SRC after it made the offer and not before. The prior seeking of SRC’s advice was a pre-condition for the constitutional and statutory validity of the offer by TSC.
