Imran* was detained in prison under immigration powers, and was unable to access a legal aid lawyer for 9-10 months. Though being held under the same powers as many detained in immigration removal centres (IRCs), Imran was held in a prison, where conditions are more restrictive and there is less, or sometimes no, access to legal advice. Since the start of the pandemic, the Home Office has sought to hold fewer people in removal centres for Covid-19 safety reasons, placing many in prisons instead.

Twenty-five years have passed since Kennedy published Eve Was Framed, the groundbreaking precursor to her latest work. And while there has been some change – much of it initiated by Kennedy herself – progress has been halting and deep-seated reform is still urgently needed. “The smell of the gentlemen’s club permeates every crevice of the Inns of Court,” writes Kennedy. And it stinks. Police often use coercive manipulation techniques when conducting interrogations in hopes of obtaining a confession. In the United States, one of these is known as the Reid Technique after the officer who developed it, John Reid. Introduced in the 1940s and 50s, the strategy relies on deception, coercion and aggressive confrontation to secure confessions. It became the leading interrogation method used by law enforcement throughout the United States and has led to many confessions by innocent people. [27] As of 2014, this technique was still popular with police interrogators even though the strategy produces less information from suspects, provides fewer true confessions and more false confessions than less confrontational interviewing techniques. [28] Perjury and false accusations [ edit ] Gross, Samuel R.; O'Brien, Barbara; Hu, Chen; Kennedy, Edward H. (May 20, 2014). PMID 24778209.Article 14(6) of the International Covenant on Civil and Political Rights (ICCPR) states that when a miscarriage of justice has occurred and the defendant's conviction has been reversed or they have been pardoned, "the person who has suffered punishment as a result of such conviction shall be compensated according to law". The right to compensation is also authorised by Article 3 of Protocol No. 7 to the European Convention for the Protection of Human Rights and Fundamental Freedoms and Article 10 of the American Convention on Human Rights. [35] The book is so well put together in clear, distinct chapters exploring the different themes that lead to the law failing women. Starting with "Eve Was Framed" following through the roles women are expected to play nice and quietly within society - "The Good Wife and Mother" and then exploring any time a woman may be outside of that definition, criminally or not. A common cause of injustice is human selfishness. As Plato described at length in The Republic, people will often commit acts of injustice when they calculate it is in their interests to do so. [3] Plato also adds that "The highest reach of injustice is to be deemed just when you are not". Human injustice is not always caused by attempt to gain unfair advantage or malice; it may be simply the result of the flawed human decision making. With the hungry judge effect for example, studies have found that judges sitting on review boards are less likely to reach decisions favorable to applicants depending on how long it is since the judges had their last food break. [18] [19] Misuse and abuse with regard to a particular case or context may represent a systemic failure to serve the cause of justice (cf. legal vacuum). [2] [9] Popular culture [ edit ] Context is everything. But this is still a lesson to be learned here and until it is, equality at the hands of the law and before the law will not be secured”.

Even when a wrongly convicted person is not executed, years in prison can have a substantial, irreversible effect on the person and their family. The risk of miscarriage of justice is therefore also an argument against long sentences, like a life sentence, and cruel prison conditions. Domestic abuse and the many women who are eventually killed by an abusive partner because the police, CPS and the law don't take reports seriously enough. Women who are deemed promiscuous resulting in rape and sexual assault not being investigated because prior to being violated a woman may have enjoyed casual sex. Women who kill or are party to murders being treated differently as the very idea of what women are supposed to be - nurturing, maternal, comforting - is destroyed by a violent crime. Reflecting Scotland's own legal system, which differs from that of the rest of the United Kingdom, the Scottish Criminal Cases Review Commission (SCCRC) was established in April 1999. Extended ‘positions of trusts’ laws to protect teenagers from abuse by making it illegal for sports coaches and religious leaders from engaging in sexual activity with 16 and 17-year-olds. The implementation of LASPO has resulted in a large reduction in numbers eligible for civil legal aid. Only around 25% of the population of England and Wales were eligible for civil legal aid in recent years. See Chapter 8 "THE QUEST FOR JUSTICE" in Vol 2 of von Hayeks's The mirage of social justice (University of Chicago Press, 1978). For a list discussing dozens of writers who have stated down the centuries that injustice, not justice, is the primary concept, look out for the long footnote under the sub heading "Rules of just conduct are generally prohibitions of unjust conduct" Maia Szalavitz (2012-02-20). The significant benefits of statutory schemes is that they provide money and services in compensation to individuals who have been wrongfully convicted without regard to fault or blame; they do not require claimants to prove how the prosecution or police committed their mistakes. According to von Hayek, the earliest known thinker to state that injustice is the primary quality was Heraclitus, whose view was echoed by Aristotle and dozens of others down the centuries. Hayek said that writers often express the idea that injustice is the primary concept "as though it were a new discovery", suggesting the view is rarely directly expressed in theories on Justice. But Hayek went on to say that legal positivism has proved that injustice, not justice, is the primary quality. [7] Sense of injustice [ edit ] A metaphorical injustice eating the innocent in Guillaume Rouillé's Justicie atque Iniusticie. The legs of the beast include adolescés sine obediétia (disobedient youth) and plebs sine disciplina(undisciplined commoners). [8]

I read Eve Was Framed in 2012 and it was revelatory, yet reading this was rather less so. Firstly, there is a significant amount in here which is a rehashing of Eve Was Framed, particularly the extended opening chapter on the status of women within the legal profession. For most feminist/social justice nonfiction, I’m looking for new angles, explorations and insights, rather than just the rehashing of the most basic details - and this book most definitely did. Even in the places where things seems obvious once she had pointed them out, they were well considered and articulated, with some lines making me wish i had a copy to annotate. The coalition, including charities, trades unions, human rights bodies and religion or belief groups, is believed to be the largest of its kind in UK history, according to Humanists UK, which established it. During the early 1990s, a series of high-profile cases turned out to be miscarriages of justice. Many resulted from police fabricating evidence to convict people they thought were guilty, or simply to get a high conviction rate. The West Midlands Serious Crime Squad became notorious for such practices, and was disbanded in 1989. In 1997 the Criminal Cases Review Commission [57] was established specifically to examine possible miscarriages of justice. However, it still requires either strong new evidence of innocence, or new proof of a legal error by the judge or prosecution. For example, merely insisting on one's innocence, asserting the jury made an error, or stating there was not enough evidence to prove guilt, is not enough. It is not possible to question the jury's decision or query on what matters it was based. The waiting list for cases to be considered for review is at least two years on average. [ citation needed] In the Name of the Father (1993), about the conviction of Gerry Conlon of the Guildford pub bombingsA major factor leading to the abolition of capital punishment for murder in the United Kingdom was the case of Timothy Evans, who was executed in 1950 after being wrongfully convicted of a murder that had in fact been committed by his neighbour. Helena Kennedy really reinforced for me why I studied law and why an impetus for change is necessary in the criminal justice system to create greater equality. Reading this book felt almost like coming full circle as “Eve was Framed” was a book which initially inspired me to pursue a law degree, and I read this book (which is in many ways a follow-up), after completing my degree.
